Aims of Module
To enable students to identify, analyse and evaluate the theories and techniques relating to the law of succession and trusts in Scotland.

Learning Outcomes for Module
On completion of this module, students are expected to be able to:
1 Consider and analyse the main principles of the law of succession and trusts in Scotland.
2 Critically evaluate and analyse the legal consequences of death and the distribution of the estate of the deceased.
3 Apply the principles of the law relating to the distribution of a deceased's estate to practical situations.

Indicative Module Content
This module will cover the law of succession including proof of death and survivorship; entitlement to inherit; the rules of intestate succession; the rules of testate succession; will substitutes; formal validity of wills; essential validity of wills; revocation of wills; restraints on testamentary freedom; and the creation, validity, nature, operation and termination of trusts.
