On completion of this module, students are expected to be able to: | |
1 | Identify the key issues of law and fact arising from legal problems relating to the law of delict. |
2 | Critically assess and evaluate the legal and factual issues relevant to the solution of the problems of the law of delict. |
3 | Evaluate and apply the principles of the law of delict applicable to the problems of the law of delict. |
4 | Explain and communicate the key issues of law relating to the law of delict to an audience. |
5 | Develop the transferable skills of good communication and effective presentation to an audience within the context of the law of delict. |
Indicative Module Content |
---|
This module will study the fundamental concepts of delict, types of liability; common law and statutory liability including a study of the Occupier's Liability (Scotland) Act; negligence; liability for economic loss; harm to reputation (defamation); nervous shock (including liability to the relatives of the victim); bodily integrity and consent for medical procedures; professional liability; defences; limitation and prescription; and remedies. |

The module is assessed by way of a single assessment component weighted at 100%. Additionally there is a participation requirement which is assessed on a pass/fail basis. Relative to the participation requirement each student is required to pass the oral presentation. Non-submission or non-completion of the competencies will result in a NS grade. An overall minimum grade D or above is required to pass the module, accompanied with a Pass for the participation requirement. | |
